1. Introduction
Welcome to FUOAI, a platform provided by PT FUOAVE NEXA CORE ("FUOAVE", "we", "our", or "us"). By accessing or using our generative AI music platform, marketplace, and creator tools, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. License and Usage Rights
Generative Output & Copyright: Users operating under a paid subscription plan (Starter, PRO) retain full commercial rights to the audio tracks, MIDI, and stems generated using our AI models (including Google Lyra integrations). You are free to distribute, monetize, and modify these generated assets across any platform without attribution. The platform claims zero royalty on your success.
Free Tier: Assets generated under the Free Tier are strictly for non-commercial, personal use, and evaluation purposes only.
3. Creator Program & Marketplace
If you enroll in the FUOAI Creator Program:
- You must hold 100% of the copyright for any asset, preset, or track you upload.
- You grant FUOAVE a non-exclusive license to host, display, and distribute your content to buyers.
- Revenue from sales is split 70% to the creator and 30% to FUOAVE.
- Payouts require successful completion of our KYC (Know Your Customer) process.
4. Prohibited Conduct
You agree not to:
- Use the platform to generate or distribute illegal, hateful, or explicit content.
- Upload copyrighted material to the Marketplace that you do not own.
- Attempt to reverse engineer the proprietary AI models or platform infrastructure.
5. Subscription, Billing, and Refunds
By subscribing to FUOAI, you authorize us to charge your selected payment method on a recurring basis.
- Refund Policy: Due to the high computational costs of generative AI models, we generally do not offer refunds once credits have been utilized. However, if you experience technical downtime that prevents access for more than 48 hours, you may request a pro-rated refund within 7 days of the billing cycle.
- Cancellations: You may cancel your subscription at any time. Your access will remain active until the end of your current billing cycle.
- Auto-Renewal: Subscriptions renew automatically unless canceled prior to the next billing cycle.
- Pricing Changes: We reserve the right to change our pricing with 30 days prior notice to existing subscribers.
6. Refund and Cancellation Policy
Due to the immediate delivery of digital credits and the computational costs of AI generation, we generally do not offer refunds once credits have been used.
- Cancellations: You may cancel your subscription at any time via the Settings page. Cancellation takes effect at the end of your current billing cycle.
- Exceptions: If you experience critical technical failures that prevent you from using the service, you may contact support within 7 days of your charge for a pro-rated refund review. FUOAVE reserves the right to evaluate refund requests on a case-by-case basis.
7. Limitation of Liability
The platform is provided "as is". PT FUOAVE NEXA CORE shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services or the generated audio content.
